    You should definately hire an attorney to assist your current husband in the adoption of your child. Your case brings up an important issue that must be addressed proactively - Sailors & Seaman's Act -- there are special rules in terminating a parent's right if they are in active duty in the military.     When you filed the I-130, you declared your mother as an intending immigrant. Her tourist visa is a nonimmigrant visa. You can't ask for immigrant and nonimmigrant relief.     All cases are different. Recently, someone sent in a letter to USCIS claiming that the husband was trying to obtain his green card by fraud. We met with the immigration officer, offered good evidence. Even though the US citizen had divorcd my client, we filed a waiver and he was granted his green card. It is all in the evidence.

    Instead of estate, do you mean a Trust? A trust can continue for many years after the death of a person. Best way to answer your question is to hire an attorney to research this issue.

    Purchasing a cond and using it as rental property is equivalent to buying stock and waiting for dividens. Such a purchase is not in violation of your H-1B.
