Description: Client had a head on collision with another across a divided highway. Officer had his mind made up that she was drunk before he ever even spoke with her. There were no field sobriety tests and no breath test. At trial, we were able to discredit the officer on a number of things and expose how he immediately assumed that she was drunk. The jury hung 5 to 1 in favor of acquittal and the charge was reduced to reckless driving after the mistrial.
