  • State of Georgia v. M.B.

    Practice Area:
    DUI & DWI
    Date:
    Apr 16, 2008
    Outcome:
Motion to Suppress Granted; Case Dismissed
    Description:
After a hearing, the Court granted Ramon's request to suppress all of the results from the arresting officer's DUI investigation; i.e. field sobriety tests, incriminating statements, and breath test results. Through cross-examination, Ramon was able to establish that the officer failed to properly advise M.B. of his Miranda rights and lacked probable cause to arrest M.B. for DUI. The Court agreed. M.B.'s DUI was dismissed.
  • State of Georgia v. M.T.

    Practice Area:
    DUI & DWI
    Date:
    Oct 15, 2009
    Outcome:
    Not Guilty after Jury Trial
    Description:
After a 2 day trial, the jury acquited M.T. of DUI. During the trial, Ramon was able to create doubt as to the arresting officer's ability to properly perform standardized field sobriety tests. Ramon successfully shifted the trial from whether or not M.T. was driving under the influence to whether or not the officer was qualified to conduct a DUI investigation. Jury decided the officer's DUI investigation did not suffice to establish M.T.'s guilt beyond a reasonable doubt. Verdict: NOT GUILTY.
  • Gwinnett County v A.H.

    Not Guilty after Bench Trial
    Description:

A.H. smelled of alcohol, admitted to drinking and had a breath test result that was more than twice the legal limit. Client acquited of DUI charges after trial.
  • State of Georgia v. K.B.

    Practice Area:
    DUI & DWI
    Date:
    Mar 08, 2010
    Outcome:
    DUI reduced to Reckless Driving
    Description:
K.B. was stopped for two traffic infractions. After his stop, K.B. admitted to drinking 6 beers. The arresting officer noticed physical manifestations consistent with impaired driving along with a strong odor of alcohol. After exhibiting 6 out of 6 clues on one of the Standardized Field Sobriety tests, K.B. refused to submit to any more testing. During the motion to suppress, Ramon was able to establish some inconsistencies in the officer's report and the video. Effectively setting up a persuasive defense for trial, Ramon got the case reduced without putting K.B. through the risk and stress associated with trial.
  • State v. C.Q.

    Practice Area:
    DUI & DWI
    Date:
    Dec 06, 2010
    Outcome:
Not Guilty on All Counts after Jury Trial
    Description:
C.Q. was discovered by the police mudbogging behind an elementary school at 1 am. At trial, the officers testified that C.Q. was unstable on his feet, had a strong odor of alcohol, refused the SFT's and State Administered Breath Test, appeared to be intoxicated, and admitted to drinking 9 beers. After a careful and thorough cross-examination, Ramon was able to successfully argue to the jury that despite C.Q.'s physical manifestations, admission to drinking 9 beers, and refusal to submit to State Administered testing, that C.Q. may not have been impaired to the point he was a less safe driver. Successful argument. Not Guilty on all Counts.
