    The Georgia Department of Driver Services regulates drivers' licenses. You must comply with their rules, which include a set amount of time with an ignition interlock device. Unless you have a financial hardship, you will have to install an ignition interlock on some car in order to get a limited driver's license and then to reinstate. If a judge doesn't find that you have a hardship and you don't install an ignition interlock, you may be in a position where DDS never allows you to reinstate your license. It's worth your time to contact DDS to find out exactly what you need to do, 404-657-9300.

  • Criminal history wants to be a lawyer

    I have 2 felony theft by taking charges from 10 years ago. I have had no other issues except a DUI on New Years 5 years ago. I want to be a lawyer, will this history keep me from being able to take the bar exam and get licensed?

    A state bar may be more interested in your truthfulness than your convictions. Contact the state bar where you'd like to be admitted, and finds out what documents you'll need to submit with your application. Gather reference letters from friends and employers as to your character today, as opposed to ten years ago. Pursues your goals, don't assume you can't be an attorney.

    Hi, I was charged with a dui a few months ago. The officer did the test at the car, but another test was never performed at the jail. Will the test he performed at the car hold up in court? Thanks!

    You've heard the expression, TMI? In this case, Not Enough Information. I'm not sure what test you're talking about. A hand-held preliminary breath test is considered positive or negative in court, but sometimes there's a machine available in the trooper's car, or in a BATmobile, a mobile-home looking vehicle with the Intoxilyzer in it. You should have already hired an attorney if you were arrested a few months ago. Discuss this issue with your attorney.

    Are you sure the DUI is the only thing showing up on your record? Get a copy of your record and make sure. You can ask one of the places that has turned you down for their copy or request one from www.felonsearch.ga.gov for around $15. You could also try getting your conviction pardoned.     It is very important whenever you are arrested to hire an attorney to represent you as soon as possible. What happens in the court may have little bearing on how the Department of Driver Services assesses a license suspension, and you need an advocate for both purposes. I would suggest that you hire an attorney and provide that attorney with your driving history and authority to speak to DDS about your license status.

    Read you application for that license very carefully. In all likelihood, the licensing agency wants you to disclose something like this, but they may issue your license anyway. They are looking for candor, honesty. It may be months before your case is resolved, and only if it's dismissed without a formal charge can you have the arrest expunged. You need to hire an attorney.

    You may need a NY attorney to deal with those old tickets. If you've been mailed a suspension notice you have a limited time in which you can appeal. GA may end up keeping your CDL suspended until you resolve all of this.

    Each jurisdiction is a little different. Go on your court date and ask; you don't have to enter the program that same day. You should consult with an attorney about alternatives to diversion.

    But essentially, you paid good money to a lawyer to represent you in court. You need to ask him or her. That is the person most familiar with your situation.
