    There is no specific time limit in North Carolina or South Carolina where I practice workers' compensation law. However, carriers are not required here to authorize care outside of the State of jurisdiction. Better to be patient. The alternative is to file a hearing request but plan on having to travel back to State where you were originally injured. Best to you.

    Would need more facts but it certainly appears you would have a claim for causally related medical bills, any lost time from work while written out of work by authorized treating physician, and perhaps, permanent partial disability if any impairment results. You should consult an experienced NC workers' compensation attorney. Best to you in your recovery.

    You don't have to be honest but any claims later can be potentially denied for fraud in the application. Better to disclose rather than later be exposed. The truth will eventually come out. Momma was right. Honest is still the best policy (pun intended).

    While I am not licensed to practice law in New Mexico, I would recommend you hire an experienced family law attorney in your area. In South Carolina and North Carolina, these types of secondary gain claims are all too common. The good news is that the truth usually comes out in the end. Now your ex-boyfriend has filed a false police report and will potentially commit perjury. No amount of legal cleverness can protect him them. Best to you.

    While I am not licensed to practice law in Arizona, the answer in South Carolina or North Carolina would depend on specific facts of negligence on the part of whomever constructed or was charged with maintaining the sidewalk. Children below the age of seven (7) are not held to typical negligence or contributory negligence defenses. However, you would still have to show some negligent act in order to proceed with a claim.

    I'm not licensed to practice law in Georgia, but in South Carolina, you would a very strong libel claim against the offending party. The only problem would potentially be collecting any judgement. Insurance does not cover intentional acts, and I am frequently reminded of the O.J. Simpson civil verdict which is still outstanding. You could effectively clear your otherwise good name and reputation. It really just a matter of how much time and energy you want to expend. Best to you.

    When initially arrested, your driving privileges are suspended for 30 days. However, you can petition the Court for a pre-trial limited driving privilege after the first 10 days. You will need to complete a substance abuse assessment (not the treatment) and provide your attorney with a DL-123 form showing active vehicle liability insurance. Your lawyer will then prepare an affidavit for you to sign showing no other pending DUIs and a valid license in good standing at time of arrest. On the eleventh day, your attorney will appear in front of a District Court Judge for approval and then filing. This LDP will become your license for up to twenty (20) days or until your initial 30 day suspension is removed. Post trial, you can similarly petition for a LDP but may be subject to a delay of 45 days or six months if your BAC level was 0.15% or greater or if you willfully refused breath testing, respectfully.

    Cheap lawyers of any stripe are everywhere. There have never been more underemployed or unemployed lawyers in my 25 year career. But beware. Like in life, you get what you pay for in law. Why does the best scotch cost so much? Because it is single malt and is over 20 years old. Same with lawyers. Singularly focused and aged is more expensive. But clearly worth it.

    This is not proper procedure and actually violates the National Highway Transportation Safety Administration (NHTSA) protocol on the correct administration of the Walk and Turn test. Because the test was not given properly, any results are invalidated. I am certified by NHTSA in DWI Investigation and Standardized Field Sobriety Testing just like the police and practice here in Charlotte.
