Can a creditor file a lien on a jointly owned mortgage in NC? The credit card debt is in my name only.

Asked by a user in Elizabeth City, NC - 6 months ago.

If you and your husband own your home as tenats by the entirities, which means both of your names are on the deed, then the real estate would be exempt from claims against either one of you. So, a credit card judgment against you on your personal account would not be a lien against the home if owned as noted.
