  • I was injured at work, and was said I was in fault. I lost my index finger and thumb. Insurance not paying, can I sue?

    Workers (comp), say I was in wrong area when I got hurt. I was working with a temp staffing company. I was insured.

    NC workers compensation is no fault. Essentially it does not matter whether you caused or contributed to causing your injury. If you were injured on the job, your claim should be paid, regardless of whether you caused your own injury.

  • I got hurt at work. But workmans comp denied me. Since I am gonna need surgery, can they do that.

    I was told that since it was not a slip, trip, or fall I was denied. BUT I got hurt at work with witnesses.

    Would need additional details on how the incident occurred in order to evaluate whether you have a legitimate claim. Just because the adjuster denies your claim, does not mean it can't be won or settled. Adjuster deny legitimate claims daily.     Age is a factor in a disability claim, however, a younger individual can overcome age if they have a physical and/or mental impairment that prevents them working along with supportive medical documentation. In younger individual cases we like to have to doctors supply supportive information in order to win the claim. I suggest you contact a board certified disability specialist in NC in order to evaluate your claim.

    First I would seek out a free consultation with an experienced workers compensation attorney. It is probably premature to thing about resolving your claim at this point. The attorney will need to determine any long term implications as to whether your will be able to perform your job long term, anticipated future medical care and whether a second opinion would be prudent at this point.
