Unfortuantley, they do have a say because they are paying the money. The concern of the defendant, in this case, the contracting company, is that if they pay you directly, you might not get your repairs done and then come back and say they still owe you money. It's frustrating but when they are paying, they can dictate the terms. Of course, you could go to small claims court and argue that they should pay you the money directly. You should contact the attorney handling the judgment. They are generally willing to work something out with you. Don't just let it sit out there unpaid as you will harm your credit score and that will adversely affect you in the future when you try to buy a house, car etc. Make the effort to call and see if you can work something out.

In Virginia, you have Uninsured motorist coverage for this exact situation. As long as your vehicle was covered you will have some insurance to go after there.
