    Description:
    Malicious prosecution case. Supreme Court for New York. Judge Gammerman. Trial judge dismissed entire action but on appeal case was reinstated. One of the few malicious prosecution cases based on a civil action to go to trial in New York. Two week jury trial resulted in jury verdict of $53.8 Million, including $50 Million in punitive damages. Listed in largest jury verdicts for 2002. Case presented multiple appeals, challenging constitutionality of punitive damages. The case eventually concluding with decision by U.S. Supreme Court to deny certioriari. see Honzawa v. Plaintiff sustained serious eye injury. Able to obtain U.S. jurisdiction against Intrados, which defended action based on Defense Base Act.
