Is there an attorney that would help me file a class action law suit against ACORN for theft of tax dollars?

Asked by a user in Norfolk, VA - over 2 years ago.

No, you have no standing to sue Acorn or any other entity for any fraud or corruption that they have committed unless you have been directly injured (It is well established that merely being a tax payer is insufficient injury to have standing for such a suit). I am sure that the U.S. government will be pursuing them on behalf of all taxpayers if DOJ believes that there is a reasonable basis for doing so.

I am on a student visa and got a student loan to pay for my education. If I leave the country without paying what will happen?

Asked by a user in Houston, TX - over 2 years ago.

Beside the ethical issues about personal responsibility for repaying student loans, there are significant legal issues, especially if you will ever want to return to this country. In addition, although unlikely, the lender could try to pursue you in another country if treaties with that country allow such suits. I would contact your lender and/or your school's financial aid office and explain the situation. Remember, student loans are usually not dischargeable in bankruptcy and will follow...

Can I pursue a case involving my former high school yearbook?

Asked by a user in Virginia Beach, VA - almost 3 years ago.

Probably not. Even if you had a claim at one point, the statute of limitations has long run on any claim against the yearbook. Moreover, even if you had caught this earlier - who would you sue? The school? The school district? Suing governmental entities is quite difficult. In addition, it may have been the publisher who made teh mistake? And what would be the damages that you could prove? There are too many problems with this case as described to pursue a lawsuit on these facts.

Do I have a case if there is a mix-up with my blood test result (as part of a life insurance application)?

Asked by a user in Richmond, VA - over 3 years ago.

If you are able to prove negligence on the part of the lab and can also prove tangible damages (other than any minor upset or inconvenience), you may have a lawsuit against the lab. Having said that, it will be a very uphill battle as it will require expert testimony to establish the negligence by the lab. I would continue your efforts to get the incorrect results taken off your record.

Can I file a lawsuit?

Asked by a user in Springfield, VA - over 2 years ago.

Like the previous answer, it is difficult to assist you without having seen the contract. Nonetheless, depending on the language of the contract, you might be able to sue for specific performance - requiring the sellers to perform their part of the bargain based upon partial performance of your side of the bargain (your down payment). You should definitely consult a lawyer as even just a phone call from an attorney might get the ball rolling on getting this deal done.

Are there any states where lawyers appearing pro se are required to appear pro hac vice as a condition of appearing pro se?

Asked by a user in Williamsburg, VA - over 2 years ago.

I have never heard of this requirement, but you need to make sure that you are understanding the court's ruling correctly. A person who has a corporation or limited liability company in most states cannot appear in court on behalf of that entity unless they are an attorney. In that situation, the attorney is not appearing pro se as teh two are separate legal entities - the attorney (even if he is the sole shareholder of tha company) and the entity itself. Please feel free to provide more...

What can be done if your child is jailed on a behavior characteristic and they are is special education in school

Asked by a user in Atlanta, GA - over 2 years ago.

If this latest incident occured in the school, you should consider appealing the determination that the incident was not a manifestation of his disability. You probably should find a local special education or ADA attorney to assist you with this matter. if you do not know one, contact COPAA (the Council of Parents, Advocates and Attorneys) through their website - www.copaa.org to get a list of attorneys in your state that handle these matters.

How are education rights determined?

Asked by a user in Louisville, KY - over 2 years ago.

Although it may be frustrating, but your ex-husband does have an interest and a right to have a voice in your son's education. The key is what is in the best interest of the child. A court would probably take into account your efforts to provide your son with an appropriate education in determining which parent has more knowledge about what is in your son's best interest, but in the end, the court will hear both sides. That is why it is best to try to cooperate on these issues and...

Child support on college bound and special education children

Asked by a user in Liberty, IL - over 3 years ago.

Although I am not an Illinois attorney, in most jurisdictions, child support can be reviewed when there are changed circumstances. Moreover, most states allow child support to continue past age 18 shen a child has a disability or otherwise requires parental support beyond their 18th birthday. You should definitely check with an Illinois attorney as soon as possible to have them look into your children's specific needs.

What to do about my class action lawsuit

Asked by a user in Saint Louis, MO - over 3 years ago.

I would agree with Michael. You should definitely contact your existing attorneys and work through them to handle this matter. If you are not satisfied with your present attorney, you need to terminate your relationship with him or her before another attorney can ethically speak with you. I would, however, first try to work it out with that attorney as they already have all of your information.
