    Reasonable suspicion is a hot button issue in almost EVERY STATE. Maryland Special Court of Appeals has held that "weaving, swerving, or pin-balling" is not reasonable suspicion. However, as previously stated this is ultimately up to the discretion of the officer making the stop. Unfortunately, there are endless reasons to initiate the stop.     In most jurisdictions in Maryland the State's Attorney will consider your prior DUI arrests out of state. Therefore, this would be considered your 3rd DUI in theory although the two priors were out of state. In most Maryland jurisdictions a 3rd offense would warrant some jail time. However, you are a resident of NJ there might be some room to work out creative sentencing. For example serving weekends.     Although you did not cooperate or comply with any field sobriety tests they very well may have a solid case against you. This is completely an issue of fact. The issue will be based on a totality of circumstances regarding your physical condition and signs on which burden of proof that you were intoxicated lies with the moving party. This would be the state/prosecutor. Consult a defense attorney asap.

    You have the right to discipline your child while in your physical custody and care. You should return the private property of your wife to avoid any litigation. You may however require that your daughter leave the phone at your x wife's residence when spending time at yours. The best advice is to try and work out an agreement with your x. Best of luck.
