Your spouse will need to file a Form I-130, alien relative petition and you will need to file a Form I-485, application for adjustment of status. However, I advise that you contact an experienced attorney to review your past immigration history and advise you of any immigration consequences that may result from past criminal activity, if this is the case. It is important to seek the help of legal counsel during as you proceed. Edward Neufville
If you have an alien registration number which is an eight or nine digit number and begins with the letter A, call 1-800-898-7180 and enter in this number. Follow the instructions to determine the status of your case and whether you have an order of deportation against you. If you have a final order of deportation or removal, depending on when you receive the order, then you have a federal warrant against you and you could be picked up.
Dear Good friend from Spain, A person who enters the United States under the visa waiver program is ineligible for change of status, extension of status or adjustment of status, UNLESS the adjustment of status in on the basis on an immediate relative petition. Since your girlfriend and soon to be wife, is a U.S. citizen, that you would make you an immediate relative. You could apply for adjustment of status. I advise that you consult with an immigration lawyer to weigh all of your options....
If your friend entered legally into the United States with a visa and barring any criminal convictions, if she marries her United States citizen boyfriend, the immigration law would allow her husband to file a petition on her behalf. If it is approved she would be able to apply and adjust her status in the United States. Because she will be the spouse of a United States citizen, she would not be required to leave the U.S.
