Savantage Financial Services, Inc. v. United States

Jon W Van Horne

Case Conclusion Date: April 15, 2008

Practice Area: Government Contracts

Outcome: Bid Protest Sustained

Description: US Court of Federal Claims bid protest against the sole source decision by the Department of Homeland to buy brand name software that was buried in a task order procurement for program support and other services. The Court rejected the government's argument that the Court did not have jurisdiction because the protester did not have standing to challenge the task order procurement. The Court accepted the definition of procurement from the OFPP Act, which included in "procurement" the government's determination of its needs, giving the protester standing to challenge the brand name determination.
