You can file a motion to modify custody which seeks sole legal and physical custody for yourself. The motion would lay out all the reasons why you feel it is in your child's best interest for you to have sole custody. Eventually, the court would hold a hearing where you would explain to the court the reasons you desire sole custody. If there is currently no custody or visitation case pending and no custody order, and you want to get an order, you need to do it in the state where the child has been living for the last six months.
