  • Can the pa, dept. of banking take your mortgage license for a summary defense

I couldn't get off it at the preliminary so I appealed it. it was a shoplifting charge for 30.00

    Michael’s Answer

This is considered a collateral consequence of the conviction. This is not part of the conviction or sentence, however a licensing board can punish you by censuring you, suspending you or revoking your license. You should contact an attorney immediately to see what can be done at this point.

Receiving unemployment depends upon the reason the employment was terminated. It is not clear why your employment came to an end.

I was arrested on a violation of a temporary order which didn't allow me to bring phone records to discredit the times and events that allegedly occurred. As well as records showing current calls being made after the final order was entered.

    Michael’s Answer

You need to hire an attorney. Trying to handle this yourself will almost certainly create issues.

I recommend that you hire an experienced attorney, preferably one experienced in employment law, to assist you in this matter. An experienced, trained attorney can expose those lies. Someone that lacks this experience is often unable to do so.

I am under the impression that, the judge will simply deny my appeal. Is this the naked truth about the Judicial Process.

    Michael’s Answer

The standards at PCRA hearings are high and many defendants believe that this is an opportunity to have a "do-over" where you can have all of the facts re-examined. That is not the case. When legitimate claims are raised properly, relief can be granted.

    Michael’s Answer

Sometimes it can be dropped when the complainant wants it dropped. If the issue with the other girl overlaps in some way, such as the other girl lives in the same house/apartment a you, that can cause certain issues if she does not want it dropped. Overall, it is based upon the alleged victim's wishes.

    Michael’s Answer

You appear to have gotten many answers. Here is the bottom line: the Commonwealth will almost certainly subpoena the complaining witness. In some cases where the complainant does not appear and does not want the charges pursued, the Commonwealth will drop the charges. In other cases, they are able to proceed without the complainant. It really depends upon the facts of the case.
