  • Are there advocates other than attys for fathers going through a custody battle.

My brother is going through a custody battle for 50/50 custody and to reduce child support. The mother does not want to give him 50/50 of their 2 yo daughter. He is an awesome father and takes very good care of his daughter when in his care.

    Andrew’s Answer

There are various support groups on line and often free for both parties. Check with the local BAR association and ask the attorney.

  • Can a protection from abuse order be cancelled if the plaintiff is continuously making annoying phone calls and hanging up?

I've been told by law enforcement I can only ignore the calls and it seems that she clearly is not in any danger by going against her own order

    Andrew’s Answer

Possibly. You could petition the court to modify and/or cease and vacate the original PFA with proof of what you have claimed. You can also subpoena telephone and cellular records to support your case. MOST JUDGES will not stand for abuse and horseplay with serious court orders. You can also report this action to the police and district attorneys office. Good luck.

  • Can I be fired because I have work hours that have been medically restricted following an auto accident when I was hired FT?

    Andrew’s Answer

You have several wonderful causes of action. First, you can sue the driver that hit you. Second you can sue for workers compensation benefits which will provide you wages of two thirds of your average weekly wages and medical bills. You also mzy be able to sue your employer under limited circumstances. Your injury case is and or most likely full tort as you were potentially working on ingress and egress for your job. There are many things to consider. But a great foundation. Feel free and call me at my office at 6108768880. You only havec two years to sue the driver and three to sue your employer, and notice must be given immediately.

    Andrew’s Answer

Obtain your file. File a petition with a criminal attorney and speak to your p.o. with your attorney. Attach a nice of file of all of the compliance and positive things you've done while on probation. Full compliance will help tremendously and a lack of a major prior record.

    Andrew’s Answer

If this is in Pennsylvania, possibly. This is a summary low level citation with fines of few hundred dollars and possible jail. Usually doesnt happen. If your found guilty and lose on appeal to the county, you can have your record expunged and wiped clean within five years. However, with no prior and u being a r good citizen there may be an alternative where the charges could be dismissed. Needs to be handled correctly.

  • How do I get my sex offender tier changed?

In 2007, I plead Nolo Contendre to F.S. 800.04, 4(a). It is a Florida statute and is defined as: "(4) LEWD OR LASCIVIOUS BATTERY.—A person who: (a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age;"...

    Andrew’s Answer

I handle these matters and am litigating a very strong case in a local county. Nothing is a slam dunk but the courts are dealing with major changes and updates in these areas. It can be an expensive proposition. But you would get a hearing and oral argument and the chance to present research and a case brief to the court. Nothing is impossible. Takes a fighter as a client.
