Can Pennsylvania Medicaid lay claim to life insurance benefits paid to surviving children?

Under current Pennsylvania law, the state can only go after Probate assets. Probate assets are any assets owned in the decedents name. Upon death a representative goes to the local courthouse and registers the will or makes the claim for inheritance under state law. Life insurance is a private contract between the owner and the insurance company. Upon death the insurance is paid directly to the named beneficiaries without any need to go through the courts.
