First you should contact your own insurance company to look into a claim. If covered for the loss, your company will pay you the cost to repair the vehicle and if it is totalled then it will pay you the fair market value. This is after your deductbile. You should probably call an auto accident injury lawyer. However, under any circumstance it it usually best to wait until you have recovered or reached maximum medical improvement. Also, if you have limited tort or full tort is extremely important.

you should consult with an attorney and see if they can look into the case for you. In some cases the second surgery may just be a normal risk and complicaiton fo the surgery. Also, the second sugery beign needed may have been the result of what you are concerned about. But an attorney who specializes in medical malpractice can review the entire claim. You should contact a lawyer. In Pa. you generally have two years to file a suit but if you did not get the ID of the car then there are a whole host of other issues to explore.

My suggestion is to file a claim in the small claims court. However, if you have your own property damage/collision coverage on your own policy then you can make a claim on your own policy. Then your company (after you pay a deductible) will pay for the damage. After all the damage is paid for then your own insurance company will do the work and try to subrogate and collect both your monies and theirs.
