    Yes a mentally disabled person can be convicted of aggravated assault, there is nothing unconstitutional about it. That being said, it can be raised as a defense in certain situations, and none of us know enough about the case to comment on whether it should have been in this case.

    A person can file a PCRA on their own within one year of sentencing, and once filed a judge will appoint an attorney to represent the person, and rewrite the PCRA petition if necessary.

    Consult with an attorney familiar with license suspensions. You may have an appeal issue. I am assuming that you plead to the highest rate because you had a reading of .16 or higher, and that you didn't have a refusal. If this is the case, definitely seek counsel for a possible appeal. If it is a refusal, however, that may explain the longer suspension.

    Yes, they can garnish a bank account, or execute and against and sell your property. You should hire an attorney to help you with the case, so you have a chance to not lose the case. Often those trying to collect on credit cards do not file their lawsuits correctly, and an experienced attorney can offer you the best defense.

    I was recently in a car accident involving alcohol.. A cop showed up at the hospital and i received a non reportable crash form. How long will it be before i know whether or not im being charged with a dui?

    They have 2 years to file. However they usually file as soon as they get lab results back showing your blood alcohol level. If they didn't ask you for a blood sample they can subpoena the hospital records. If you are charged consult an attorney immediately. Don't make any statements regarding drinking.
