How does a Writ of Execution work if the person still lives with parents and doesn't work?

You can have the sheriff serve the writ on every bank in the area where your friend may have a bank account and the bank is required to stop all withdraws on the account and turn the money owed over to you. You should either go to a lawyer or if that is economically not feasible go to your county sheriff's office and ask if they can help with execute on the judgment. Good luck.

When is the last possible time to ask for a remand from federal to state court?

As I understand your situation your attorney originally filed suit claiming the damages were less below whatever the threshold amount for mandatory state court arbitration. You then insisted that he ask to amend the complaint to please an amount of damages in excess of the the amount for mandatory state court arbitration. When that was done your former employee moved to remove the case to federal court based on diversity jurisdiction. Federal court does have mediation and arbitration programs....

As stated by the US Department of Labor website employers are required to pay at least 1 and a half time the regular pay for any hours worked over 40. http://www.dol.gov/dol/topic/wages/overtimepay.htm If your employer is not doing so you should contact a lawyer in your area. The Pennsylvania Wage Payment and Collection Law provides for attorneys fees and triple damage in instances where the employer is not properly paying wages. Good luck.

I am very sorry to hear of your loss. Where you told the cause of your baby's death? Was an autopsy done? As I lawyer who regularly handles medical malpractice case, I would want to know the answers to those important questions as the first step in deciding whether or not to pursue a matter. As Mr. Dane suggested you need to find an attorney who has experience investigating and handling medical malpractice cases involving pregnancy and labor and delivery.

Although I don't practice in NC, your future husband could not be included in the lawsuite unless he owned the car you were driving. If you had insurance, I would expect that your insurance coverage would protect any personal assets. If you don't own have any ownership in the house, I don't see how they could go after your fiancees home.
