also known as Rosenhouse Law Office
I'm Michael A. Rosenhouse, a Rochester, New York appellate attorney. I focus my practice on civil appeals and appellate motions in state and federal courts. I represent both appellants and appellees, and I collaborate with other attorneys who need appellate assistance on complex, time-intensive cases. My appeals have addressed a range of issues, including securities fraud, breach of contract, ERISA, estates, defamation, nuisance, equitable distribution, personal injury, and professional malpractice, among others.
I am admitted to practice in New York and Illinois, before the U.S. Courts of Appeals for the Second, Fifth, and Seventh Circuits, and before the U.S. District Courts for the Western, Southern, and Northern Districts of New York and the Northern District of Illinois. I hold Martindale-Hubbell's AV Preeminent peer review rating, and I received the Karl N. Llewellyn Memorial Cup for Excellence in Appellate Advocacy at the University of Chicago Law School. I have authored New York Pattern Jury Instructions Companion Handbook and New York Trial Objections, and earlier in my career I served as managing editor of American Jurisprudence (2d) and American Law Reports, Federal.
I earned my J.D. from the University of Chicago Law School and my B.A. from Yale University. In addition to my Rochester office, I maintain an office in the Chicago area.

Won reversal on appeal of judgment; the Appellate Court enforced the lease's forum selection clause and ordered dismissal of the suit against the client without prejudice.
The Fourth Department agreed that the proceeding was properly brought and included the proper respondents, but dismissed the petition, finding no excess of judicial authority and holding challenges to the earlier judgment untimely.
Court of Appeals reversed; the fee motion was denied and the client was relieved of any obligation to pay the AFC's fees.
The Fourth Department unanimously vacated the civil-contempt finding and $535,000 fine, holding that the deed-transfer directives could not support contempt because the court lacked jurisdiction over the affected nonparties.
The court modified the judgment to grant additional 90 days to refinance marital residence before sale required, otherwise affirmed..
Judgment modified in client's favor: nuisance injunction and damages claims reinstated.
Partial summary judgment on liability won; matter remitted for inquest on damages. Affirmed as modified.
The Fourth Department upheld the determination that my client was the surviving spouse and the denial of the sister’s petition for appointment as administrator, while vacating fee awards against her.
The Fourth Department reversed the dismissal and reinstated the medical-malpractice complaint, finding no showing that the plaintiff’s discovery noncompliance was willful, contumacious, deliberate, or in bad faith.
The Second Circuit upheld the pension calculation but remanded for clarification of the separate equitable-relief claim concerning delayed payments.
The Fourth Department upheld my client’s separate-property credit and reduced his required IRA rollover, while otherwise affirming the divorce judgment.
The Second Circuit affirmed summary judgment, finding insufficient evidence of discrimination or retaliation and no constitutionally protected entitlement to reappointment.
The court denied dismissal of the civil-rights conspiracy claim against the remaining moving defendants, allowing that claim to proceed. The case subsequently settled.
Summary judgment for our client affirmed on appeal; court held the counteroffer rejected the original offer, so no contract was formed.
The Supreme Court denied review, leaving intact the Seventh Circuit’s decision sustaining substantial relief for the derivative plaintiffs.
