Heron v. The County of Monroe

Brian Arthur Macdonald

Practice Area: Defective / Dangerous Products

Outcome: "No Cause of Action" in favor of Defendant

Description: Plaintiff was a baggage handler at the Rochester (NY) Airport. He alleged that a baggage conveyor system was defective, which caused him to sustain a back injury after he attempted to clear a baggage jam. Plaintiff claimed that he had to climb into the machine, which then unexpectedly started, throwing him down and causing his injuries. The jury found no defect in or failure to maintain the machine, and found in favor of the County of Monroe, the owner of the airport. Plaintiff had sought a $375,000 settlement.
