A lot will depend on your BAC test result, your performance on field sobriety tests and whether you were cooperative with the Police Officers. The document charging you with ADWI probably says BAC over 0.18; this does not mean that your BAC was 0.18. Whether you are offered a plea to the lesser offense of DWI, which is a misdemeanor, will likely depend on your BAC.
