There could potentially be a breach of the standard of care in your diagnosis. You should consult with an attorney to review your situation (who will to have it reviewed by a physician). To have a valid claim, you will have to prove many things including the fact that you were wrongfully misdiagnosed. Since you are posting in DWI, I can assume that you have a DWI arrest, and that your disposition required the assessment. In this scenario, assuming liability, your damages would be your time,...

If money is an issue, and the offense you were charged with is a mere violation, you may consider pleading guilty to the offense (paying the fine could cost less than paying at attorney). If you wish to fight the ticket, you should appear in court to let the judge know that you wish to meet with the DA. The DA may offer you a reduction, however courts are often overburdened and the Dist. Atty. may not be responsive to you. An attorney will be able to handle this matter for you without you...

No, but if it was drugs, this would be a possible collateral consequence of a conviction.

You have 90 days in New York to file a Notice of Claim against a municipality. Depending on the severity of the damage, the value of the car, the deductible and other factors, it may or may not be worth hiring a lawyer. Any lawyer in town should know the procedure for filing a notice of claim. I concur that it would be easier to obtain the cost to repair the car from your insurance company (if you have it). However, there are many situations where you will not obtain the full value of the car...

The circumstances that you have described could be a basis for a medical malpractice lawsuit in New York. The failure to provide adequate prenatal care could provide a basis for finding that the physician failed to act within the standard of care for obstetricians/gynecologists. There are customs and practice for treating expectant mothers including the identification of strep in certain circumstances. The cause of action for the loss of a baby through miscarriage was not sustainable until...

Unless you had multiple tickets opened and you received an Aggravated Unlicensed Operator charge, I doubt that there would be a bench warrant for your arrest. If there is an active bench warrant, I would recommend that you hire an attorney in New York to address this issue for you. You should begin by contacting the court clerk's office as my colleague advised.

My principal concern with detaining someone when there is no confirmation of a crime would be that you yourself could have committed unlawful imprisonment. I agree with my esteemed colleague's opinion regarding contacting your employer's attorney. Depending on your area, whether or not you get prosecuted for detaining the person, would be an open question. This crime is a misdemeanor and as such, you can receive a term of imprisonment for up to one year in New York.

I don't think I can see a case here. He may not have used the best technique, but I do not know that this is malpractice. The damages would be minimal from what you have described so you may have difficulty finding an attorney to accept your case. If you feel strongly, you should attempt to contact medical malpractice lawyers in Brooklyn for a free consultation. You should be aware that there is a statute of limitations of 2 1/2 years for dental malpractice in New York.

It sounds as if you have a potential products liability case. I agree with the other posters that you should contact an attorney in New York who handles this kind of case.

You should consult with an attorney in your area to review your dental care. Base on what you have posted, it may have been a breach in the standard of care. However, only a dentist will be able to determine whether or not there was dental malpractice.
