    Chase is counting on someone not taking this b/c the amount is so low. That said you can bring it yourself in city or district court or if you can show Fraud, a lawyer may be interested in treble damages. Talk to State AG and contact State Banking Dept.

    A number of these homes have inadequate driveways however the Village points out the need to put your vehicle in your garage. Sidewalk blocking is a safety concern. I do not find a right to park in your driveway to rise to a constitutional level to oppose the ordinence

    The burden of proof is on the agency, however it feels like you have the burden because people in the system feel like you are at the court of a reason. First thing you must do is ignore the community and courthouse scuttlebutt. Then make sure you have a really good family lawyer who knows his or her way around abuse and neglect cases. They may ask you and your husband to participate in counseling programs. Go only with your lawyers permission. Also do not talk about the case with anyone other than your spouse or your lawyers. No one else needs to know anything. Keep visits with your child happy and friendly and of course do not discuss the case with him either. Keep the faith. You do what your lawyer tells you, it should work out just fine. Good luck.

    Yes they can. They may have a hard time getting the charge to stick however after a suppression hearing. Your brother should make sure he has a good lawyer who is up on his criminal procedure. Conferencing with a civil rights lawyer wouldn't hurt for the second part of the case (suing the cops for violating his rights.) Check out the AVVO attorney's in your home area. I will bet you find a good group of Criminal Defense lawyers on here. Look for lawyers who belong to the NCACDL or the NACDL or are active in (not just members of but leaders of )the State Bar. Ask if they have ever handled a suppression hearing to suppress the proceeds of a bad search. Look to see what the other lawyers say about their work. See if they have ever lectured in CLE classes on the topic or written articles published on the issue. Then look for someone with at least 5 years experience and better if they have more. Why? Because gun cases are harder than most and you want someone who's experience level is up to the work.

    You should hire a criminal lawyer. There are a bunch of good ones right in Dallas. You need to protect yourself from both legal charges and the credit card charges. Fraud is a very serious crime and it would make finding another job nearly impossible. Run do not walk to a good criminal lawyer with experience in handling White Collar crime. Good luck.

    I mildly disagree. You have a eight to ab adversarial hearing on the document. Even if you consented you can appeal that you were not advised of the effects of the consent. Consent must be knowing and intelligent.

    if you get fired you can more than likely sue at least for retaliation. sounds like you may have more. Run(don't walk) to see a lawyer about this ASAP

    Yes to an extent. Peace officers are quasi police officers and article 23 section 750 (5) specifically excludes police dept. from the statute.
    Further even if you are eligible given the type of job you are seeking it could be color-ably claimed that these prior convictions could render you ineligible for the job you are seeking

    is there a question here? If you are asking if the five prior arrests are stopping them from hiring you, well no one arrest is probably doing that except for maybe the impaired however if being a driver is part of the job and if you will be driving their vehicle you might understand that the overall look is not a good one.
    Can they not hire you? Not necessarily based on your arrests but if the have a similar or better candidate without this arrest record guess who gets the job.
