You should still receive wages from 9/1 - 9/15. Make sure you provide a copy of any denial the insurance company sends you to your lawyer. Good luck.

  • Should I arbitrate a no-fault denial of lost wage claim with my injury lawsuit still pending?

Hit by a yellow cab in manhattan. I have been out of work for 7 months. I received letter from insurance stating my claim for lost wages is denied because IME said accident didn't cause my injuries. It can be appealed to arbitration. My lawsuit ha...

    Jeena’s Answer

I doubt any arbitrator will agree to hear your lost wage claim while your injury lawsuit is still pending. In my extensive experience, arbitrators will dismiss the claim without prejudice for you to refile because any decision they render MIGHT have detrimental effect on the injury case. Good luck.

No intent is required in a negligence action. The plaintiff has to prove that the defendant breached a duty of care. You should speak to a lawyer in person who can defend you if you receive a law suit.

    Jeena’s Answer

You may have a case for failure to properly diagnose, however, the only way to know for sure is to discuss all of the facts with a medical malpractice plaintiff lawyer. The consultation should be free, no matter who who choose.

  • Can i sue a hair salon for burns on my scalp?

i went to a hair salon yesterday and they bleached all my hair, after i was done i went home and tried combing my hair out as i was combing my hair it hurt and i also felt like scabs on my scalp also part of my hair is stuck to my scalp im scared ...

    Jeena’s Answer

Did you go to the hospital or dermatologist in order to obtain a diagnosis and prognosis? I would start there. You don't want the burns to get worse and you may need to treat them. In the meantime, did the salon perform a patch test before they bleached? There are good personal injury lawyers in Staten Island who will speak to you during a free consultation. Please go seek one out.

Feel better and best of luck!

  • We hired a compensation lawyer for our sons accident do we need to hire a disability lawyer as well

Our son fell off ladder at work Operated on rod in right leg screws in left leg Will be going for major. Therapy nowl

    Jeena’s Answer

Consult with a local personal injury lawyer. Your son may have a claim against the commercial property owner for what is known as a "gravity-related injury". If your son is out of work, then disability may come into play as well.

  • Can an employer not give wage and hourly rate on nf6 form to insurance carrier from a no fault accident?

my company states that my insurance company needs a subpoena to get wage information for a no fault accident.is this legal?

    Jeena’s Answer

If you signed the section which releases your work loss information on your No Fault application for benefits, then the employer should provide wage and hourly rate to the no fault carrier. They do not need a subpoena. If you have a personal injury lawyer, bring this issue up and have him or her speak to your employer.
