  • Hi, Got a ticket for driving without a license, moved and never went to court to address it. How do i go about correcting this?

This happened about 1 year ago.

    Daniel’s Answer

You may be facing serious consequences for not appearing at the court date. This could include a bench warrant being issued for your arrest. You can contact the court or retain an experienced traffic attorney to help you clear this matter up.

  • If my license are revoked in North Carolina can I get my driver license in the state of New York

For not paying a speeding ticket

    Daniel’s Answer

New York DMV may ask you to provide your driver's abstract from NC or may run the report themselves. In addition, even if you manage to get your license here in New York it is typically only a matter of time before the out of state suspension catches up with you. Contact a NC traffic attorney to help you clear up the matter or pay the fine so you don't have to worry about it.

  • The officer miswrote my registration number on a ticket, do I have a case?

It was a moving violation(marked lanes, unlicensed operation due to JOL restriction violation). He was off by one number and it is clearly written. It is a full "Z" rather than the "7" it should be.

    Daniel’s Answer

An error of this type isn't serious enough to result in the ticket getting dismissed. Consult with a local traffic attorney to discuss how best to proceed.

  • Do you know the rules for proper use of a radar gun in regards to accurately targeting a speed violator?

I recently got a speeding ticket and the officer was not even facing me as I passed him on the highway. He said I was doing 70 mph on a 50. Normally when I see an officer trying to get someone for speeding, they are actually facing the opposite w...

    Daniel’s Answer

As my colleagues have pointed out, most radar guns in use can measure speed of vehicles heading towards or away from the point of origin. If the ticket was issued in the Bronx I suggest you contact an attorney who is familiar with the Traffic Court (TVB) system.

Got a speeding ticket for 20 miles over the limit plus 4 points. How do I fight and win a speeding ticket?

    Daniel’s Answer

Depending on the court that the ticket is returnable to, you may have the opportunity to engage in plea bargaining. This is not always the case however, as the New York Traffic Violation Bureaus do not typically agree to lessen the charge. Consult with an experienced traffic law attorney.

In NYC Traffic Violations Bureau there is no plea bargaining down a ticket to a lesser offense. If you request a hearing you will either be found guilty or not guilty of the offense charged. You need to consult with an experienced NY traffic court attorney.
