    You must fight it. You can get this type of summons dismissed. The fact that you are on probation makes it even more serious.

    As a technical matter, the summons could result in the ACD matter being restored to the calendar. However, as a practical matter, it is highly unlikely that the summons will result in the ACD being restored. It rarely happens as result of a summons being issued. There are issues regarding the legal sufficiency of the summons. A review of the reverse side of the summons in the court file would shed some light on the issue.     If someone conducts a background check while your case is pending, it will show up as a pending case. The matter can be resolved quickly and the case can be sealed if handled properly by an attorney. Deron Castro

    Your son needs a lawyer immediately. Having dealt with homicide detectives on numerous cases in the past where a person was under investigation, I must warn you not to trust anything you are told by them. This is a serious matter that can be handled but you must address it as soon as possible. You cannot control what the newspapers have already published but you can protect your son from an illegal arrest or prosecution. Deron Castro

    You must speak to your attorney to have a clear understanding about any offer being made by the prosecutor. You may receive an ACD but you lawyer can find out in advance about whether completion of the parenting class will lead to an ACD.     Generally, you may see a difference in the type of supervision you receive in Queens as opposed to Suffolk County. Obviously, it depends on the individual probation officer but the higher caseload in Queens may lead to less contact required between you and probation.

    You need to keep your distance from this person and retain a criminal defense attorney. You should not plead guilty. This case can certainly be resolved in your favor without you being left with a criminal record. This type of case is not unusual but you need to make sure that you don't find yourself in a position where she can make yet another false allegation and have you arrested fro violating an order of protection.
