  • Wore handcuffs for 12 hrs. Key broke off in the cuffs. Injured when cut out with grinder.

Filed a negligence lawsuit against the police dept. Can you try the case and win without a expert handcuff witness. The police destroyed the handcuffs and entered a picture of handcuffs as evidence.

    Jeffrey’s Answer

Agree with Attorney Bain. You have the "burden of proof", not the municipality.

I contacted pepsi immediately and they have handled it poorly. Are there any lawyers in VA that would like to file suit for me?

Is it normal to have your deposition and dme a year apart from one another

    Jeffrey’s Answer

DME is a term more frequently used by a plaintiff's attorney. Why are you 2nd guessing your lawyer?

How long before trial must the plantiff and defense disclose their expert witness and after they do what happens next

    Jeffrey’s Answer

Lawyers who litigate can easily answer this, however, because it really encroaches on legal advise and perhaps strategy, your attorney should be the one to address this. That said, look at CPLR 3101(d) and the case law.
