    Most importantly, notify your insurance carriers (auto, home) asap. If you are named on the title/registration you will likely be named in any litigation. If you didn't have sufficient coverage and if the injuries warrant a substantial award then marital assets may be vulnerable.

    Your insurance should not increase for a non-chargeable collision. If they raised your rights, chances are they determined you to have at least some share of the blame. As to the deductible, you should receive reimbursement of that off-set by your percentage of fault. If not clear, please advise.

    Agree with Attorney Katz if you have insurance, agree with Attorney Hudson if you don't. If you don't, you can also sue in small claims court; not to exceed the jurisdictional limit, that could be less than your actual damages. Good luck.

    There is NO hard and fast rule. Numerous factors go into how/why/when a case is resolved. What makes a "good" case better is with qualified representation, and what makes a "good" case worse off is no qualified representation. Good luck.
