I am married in another country but we are already separated, he want to sue me, is that possible?

If you or your husband meet the residency requirements of NY State, he can sue you for divorce here. To be valid, he must have you properly served with a summons for divorce. You would then have an opportunity to contest whatever aspects of the divorce are appropriate, or make a claim of your own for support, equitable distribution of marital property, etc.
