Can I change judge in a divorce case?

Asked by a user in New York, NY - about 1 month ago.

For all practical purposes, you are probably not going to be able to change judges unless you can show that the present judge has some relationship with your husband that would make it difficult for him to be impartial. You don't say in your question how long the judge has refused to act, or why he may be delaying action. You don't say whether you have appeared before the judge yet. Do i need a lawyer for uncontested divorce?

Unless you are quite knowledgable about how divorce will affect these areas of your life, you may regret not having an attorney help you through this. I am a New York Attorney, and do not practice in Florida,...

Procedure in NY state to reopen modify divorce decree entered 15 years ago, appeal or motion to reconsider divorce decree

Asked by a user in Brooklyn, NY - almost 4 years ago.

It would not be possible to have the judgment vacated after 15 years. You may be able to have those aspects of the judgment most harmful to you modified. For instance child support can be reduced upon a proper showing. So may spousal maintenance. Child custody and visitation may also be modified if a good reason exists to do so. You fail to state in your question whatpart or parts of the divorce judgment you object to, nor do you offer any facts which would help someone whether a court would...
