Can I travel outside of the US if i have a misdemeaor (for illegal possession, first & only offense)?

Asked by a user in New York, NY - over 1 year ago.

You would have to verify this with a seasoned immigration attorney, however, I don't believe that you would have a problem. The story would of changed if ICE put a hold on you prior throughout the duration of your contact with the Criminal Justice System. If they did, I wouldn't go. But, Please do not rely upon this and contact an immigration attorney.

What is the minimum sentence for a PL 120.05 in New York? No priors.

Asked by a user in New York, NY - over 2 years ago.

The answer is: IT Depends. The absolute minimum, if you take a plea to the charge is 3.5 years if it is an indeterminent sentence (you know, 3 to 5, or 10 to 15, etc Think Law and Order) The other factors that are must be considered is what county... New York versus Kings, etc. Kings, you'd probably not get indicted, get an A misdemeanor, with a 60 day split. while in Manhattan, they'd press the felony. (New DA must make his numbers) Another factor is how injured the person was/is...

I was issued a summons in NYC for public urination under Section 16.118- will this go on my record?

Asked by a user in New York, NY - over 2 years ago.

This will absolutly not go on your record. This summons is a violation of the administrative code of the City of New York. Violations are not crimes. You will not have to answer that dreadful question on applications "were you ever convicted of a crime?" in the affirmative. Don't pee in public. There are plenty of bathrooms. Pay the fine, and move on. Anthony P. Ruffini, Esq. 718-227-3003 Ruffini & Associates, P.C. www.ruffinilaw.com

Desk Appearance Ticket "Not Ready"?

Asked by a user in New York, NY - over 2 years ago.

Relax....If you were in Manhattan or Brooklyn, not being ready on DATs is a common practice. They probably told you to sign the book to prove you were there. 99% probability is that your case will be dropped. If they don't proceed within 90 days, it is Thirty thirty'ed (Speedy Trial) dismissed and can never be brought up again. Congrats. your case is most likely going to be dismissed. Anthony P. My friend is charged with armed robbery, conspiracy, attemped kidnapping.

Asked by a user in New York, NY - about 3 years ago.

Good afternoon. This questions has multiple parts with multiple answers. As a former prosecutor, the reasons for putting pressure on one person, in an effort to get more substantial evidence on another is a daily occurrence (although, not illegal, it may be unethical if the prosecutor lies)/ A coached confession can be attacked in a hearing. However, if there is a signed miranda waiver card, it would make challenging it a bit difficult, unless there is clear coercion (was kept up for forty...

Dwi

Asked by a user in Manasquan, NJ - almost 4 years ago.

The answer depends on what you mean by receiving a DWI in 1990. Were you convicted of a Misdemeanor or Felony, or did you plea it down to a violation or traffic infraction. The arrest will no doubt show up on your print check, but if you were up front and honest about it, I don't believe that a DWI from 18 years ago will affect your nursing license today. Good luck. Seeking criminal defense attorney in ceres, CA area that takes pro bono cases

Asked by a user in Ceres, CA - almost 4 years ago.

The website for the State Judiciary in your state should have the contact for the local bar association. In many states, such as New Jersey, lawyers are required to do pro bono. I practice in New York and I do a few pro bono cases a year.

Is this an act of negligence?

Asked by a user in Staten Island, NY - over 1 year ago.

You must sit down immediately with a Med Mal Plaintiff's attorney. The statute of limitation is shorter in NY for MedMal cases, then for regular cases.

140.05 Trespass will result in ACD or dismissed?

Asked by a user in New York, NY - over 1 year ago.

Kevin is absolutley correct. Make sure you get there early with proof of residence. Bring your cousin if at all possible. I believe that you will most likely get an ACD.
