Sexual misconduct and medical malpractice lawsuit

Asked by a user in Waterford, NY - over 3 years ago.

There is only ONE attorneys fee, no matter how many lawyers you have. tha t is if you find a new lawyer that lawyer will have to share the fee with the outgoing lawyer according to how much work on the case each has done. Also there will not be any duplication of any discovery already finished, (ie. depositions, medical exhanges, etc.).

Can a passenger in a taxi cab sue both the car that hit us and my driver for driving too fast

Asked by a user in New York, NY - over 3 years ago.

As a passenger in one vehicle that was in an accident with another vehicle you can and should seek to hold both drivers responsible for any injuries that you may have suffered in the accident. As far as lost wages and medical payments those would be covered up to $50,000.00 under No-Fault in New York. You MUST file for those benefits within 30 days of the date of the accident. The law is very strict on that point.

Should we hire a malpractice attorney?

Asked by a user in New York, NY - almost 3 years ago.

It does appear that there may be a valid cause of action on behalf of your daughter, however I must caution that without more information than is contained in your question a definite decision to proceed cannot be made. Once the records are obtained, they would have to be reviewed. As these types of cases are handled on a contingency fee basis, it would not involve any cost for your daughter to consult an attorney experienced in medical malpractice. if she is interested in pursuing the matter...

Can i sue for medical malpractice?

Asked by a user in New York, NY - almost 3 years ago.

There may be malpractice, but that is only the beginning of the inquiry here in New York. There are many other facts that would need to be discussed before a decision about proceeding against the medical provider could be made. Was this a physician or a podiatrist that performed the surgery? What was the surgery for? Where was the surgery performed, in a hospital or in the doctor's office? These are some of the questions that an experienced medical malpractice attorney would need answered...

My mother died after getting an infection while at the hospital, can I sue the hospital

Asked by a user in New York, NY - over 3 years ago.

There could be a medical malpractice suit for wrongful death against the hospital and the doctors. It would be necessary to see the records and get a complete history inorder to make a valid determination whether to proceed with the case. Did the lawyer you hired consult any medical experts and have the records reviewed? The first place to start might be to get a complete picture from your present lawyer and an answer as to why nothing has been done. If you are not satisfied with that you can...

Motorcycle accident

Asked by a user in New York, NY - over 3 years ago.

If you were physically injured I would advise you to, at the very least, consult an attorney who specializes in handling personal injury matters before you contemplate any settlement. In general, insurance companies and insurance adjusters that you may have dealt with are looking out for their own interest and NOT yours. They will be inclined to get you to settle before you have an attorney because it will usually mean they are paying you less then what you are entitiled to. Attorneys who...

Yasmin mass tort - looking for representation

Asked by a user in New York, NY - over 2 years ago.

Choosing a lawyer to represent you in this is not an easy task. You need to meet face to face with the lawyer or lawyers in the firm you are "interviewing " for the position of representing you. You need to feel comfortable with the individual you will be dealing with. You can do some research by going to their web site and other attorney rating sites. Are they members in good standing with New York State Trial Lawyers, for example. Yasmin or drospirenone as it is properly known has been...

I lost my son! Should I hire a Malpractice Attorney?

Asked by a user in New York, NY - over 2 years ago.

While the situation you describe is truly tragic and my sympathies are with you, there is not enough information contained in your question to determine if the is a viable case against the doctors and hospital. I would urge you to contact a law firm that handles matters of Medical Malpractice so that all the proper questions could be put to you to gather the necessary information to determine if your case has any validity.

My car was hit by a drunk driver while it was parked? What can I sue for?

Asked by a user in New York, NY - almost 3 years ago.

Based on your question it sounds like you can't sue at all. Unless you have the name and/or the license plate number of the offending vehicle you can't sue anyone. You would also need some proof that the offending vehicle collided with your parked car, the damage alone would not be sufficient to prove your claim. You should contact your own insurance carrier if you have collision insurance, if not you may very well have to suffer the loss of the cost of repair.

Do I need a defense attorney in a pedestrian claiming personal injury against a bicycle(me)

Asked by a user in New York, NY - almost 3 years ago.

If you have Homeowners Insurance you should contact the carrier and report this to them as they will cover you for this event and provide you with an attorney to defend you. If you do NOT inform them of this claim against you they may try to avoid covering you for the accident as you are required to inform them of all potential claims against your policy as soon as you become aware of them. The failure to do so may give them an adequate reason to NOT cover or defend you. If you do not have...
