Yes, if you both agree on the grounds for divorce; child custody, visitation and child support; and the division of marital assets and liabilities you can get an uncontested divorce. Our law office offers free uncontested divorce consultations.

The fault grounds of adultery or the fact that one party committed adultery does not effect the equitable distribution in a divorce. None of this is effected by the n0-fault divorce law either. Can I be made responsible for another person's existing debt if I marry them?

A pre-nuptial agreement would be a good idea. With a prenup you can retain control over how marital assets and liabilities are dealt with, among other things.

Can i file for uncontested divorce without an attorney even if im on a student visa

If you meet the residency requirements, then, yes you can file for an uncontested divorce even though you are here on a student visa. I always recommend that people use an attorney. NY No-Fault, Legal Separations still Obtainable?

Yes, legal separation agreements will still be a viable option regardless of the new no-fault law. They used to be required in order to get a conversion, or no-fault divorce. Now they can be used to govern the rights and responsibilities of you and your spouse during a period of separation. The no-fault law will be in effect October 14, 2010. Legal Separation is already executed... Can one party go file for No Fault?

Yes, one party can file under no-fault regardless of the separation agreement. The legal separation agreement no longer needs to be for a year because of the new no-fault law. You or your spouse can file under the new no-fault law as soon as October 14, 2010, when the law becomes effective. I agree that suing your wife for destroying your belongings may not be worth it. That would depend on the value of your property, whether your wife has the money to pay a judgment against her and whether you could afford an attorney to sue her. In New york State, do I have any rights legally knowing my spouse broke up the family do to infidelity?

Although New York is still a fault state in terms of divorce, fault has little bearing on equitable distribution of assets. The fault provides grounds for divorce. In other words, the court will allow you to get divorced because you have proven fault. Otherwise, you would have to stay in the marriage.
