What can I do to get my money for an online transaction the internet retailer and the wire company refuse to pay

Asked by a user in Brooklyn, NY - over 3 years ago.

Hi, I am in NY, too... Okay, if his account was in fact hacked in to, the buyer's course of action would have been to refuse shipment from UPS. Once he accepted shipment from UPS and didn't return or dispute, he, in essence, accepted the transaction. I think you have a cause of action for breach of contract. I would need more info as to your store policies, etc. Let me know if I can be of more assistance. Natalie

If a band has prior use of lyrics can a third party copyright those lyrics after the date of prior use?

Asked by a user in Albuquerque, NM - over 1 year ago.

The answer really depends on who authored the lyrics. According to copyright law, absent a written agreement or work for hire, the copyright belongs to the author. Was the band member the author of the lyrics, was it a collaborative work, when the band recorded the CD, did they assign the rights to the label... These are all questions that need to be considered in answering this question. Feel free to follow up.

Can I get in trouble for logging onto my ex's email if she gave me the password?

Asked by a user in Taylor, MI - over 1 year ago.

When you were going out with your ex and she gave you permission to access her account that would be considered a permissive entrance. Since you have since broken up, you would have to assume that your permission to access the account was revoked. Accessing her email since you broke up could be considered, among other things, criminal trespass and an invasion of privacy. It would be prudent to stop accessing the email.

Can I be sued to remove someone's name from my blog?

Asked by a user in Newark, NJ - about 2 years ago.

I agree, the answer to can I be sued is always yes. In this case, I would assume that the person would pursue a defamation of character suit as well as others depending on the specifics of the case. While freedom of speech is protected on the web as everywhere else, you should be cautious of what you say about other people. My advice is not to use the full name. Whether or not people can surmise who you are talking about depends on the circumstances. Defamation is a false and...

I purchased a product over the internet and did not recieve what I wanted. How can I get free legal help?

Asked by a user in Burlington, WI - over 3 years ago.

Edith and Hershey, Your first course of action is to read their terms and conditions. See what their return policy is and how they have outlined procedures for disputes. BBB and your credit card company is a great first step, but if your grievance still goes unanswered you should turn to a Bar association in your area for a lawyer that can help you with this matter. The Bar Association might have free legal services, as well. Pertaining to your question whether you can take them to...

I want to voice my opinion on how Netflix does a little dirty business, would this be libel?

Asked by a user in Austin, TX - almost 3 years ago.

If your opinion is truthful and of public interest you should be able to post your comments. My advice is to relay your opinion truthfully and in a helpful manner.
