  • How does section 4 of N.Y. CPL. LAW § 30.10 impact the SOL for someone who comitted a crime in NY but lives out of state.

If a suspected misdemeanor was comitted in NY by someone who lives out of state would section 4 of N.Y. CPL LAW 30.10 extended the standard SOL by 5 years thus making the SOL 7 total years? (2 years for misdemeanor + 5 years from section 4)

    Arkady’s Answer

Generally the SOL is for all perpetrators and is three years. If you are wondering if you can come back into the state you might want to call an attorney.

    Arkady’s Answer

An 18B lawyer is court appointed and at no cost to the defendant like a public defender. However, this is an attorney that takes some of these cases, but is in private practice. They are usually appointed if the public defender has a conflict.
