Regarding your "potential claims" for assault, it does not seem, from your question, that your husband himself actually contracted any communicable diseases that you're aware of. So I don't think you'd have a claim for assault. That cause of action requires an ability to effectuate the threat of harm. A "reckless endangerment" claim is usually similar: if you don't place a person in danger, you're likely no recklessly endangering her. So my intuition -- unless someone's actually contracted...
