    Your medical costs are covered by your own PIP insurance. The deductible for your property damage (your car) is recoverable by suing the other driver. The deductible and co-pay for your medical expenses are not recoverable because NJ is a no-fault state. Depending on your insurance you may need to have a permanent injury in order to collect from your own uninsured motorist coverage.     Hopefully there is a legal problem with your stop or a technical problem with the machine otherwise there's not much else left to argue with the Alcotest machine. Unless you had a reading below .08 of course, which is doubtful. You can write your state legislature about instituting a hardship license in NJ, that probably will not help your situation if you are guilty but may help someone in the future who is in the same position as you.     Make sure you keep the repair records from the car so that you can prove that it was not operable at the time the police arrived. You may need to bring the mechanic in as well.     You are not required to hire an attorney but you can do so so that your rights are protected. Court appearances are required at the discretion of the officer but usually only happen on your type of ticket when there are injuries so that the victim can be heard. John Ducey 732-458-5600

    If they determine that you did not tell the truth on an application they can rescind the contract back to the start date. This is because they were insuring a risk and if there was not accurate information on the application the risk may have been greater than what they bargained for. They will have to sue you in order to rescind. If they do sue you, you should retain an attorney to defend you and counterclaim for performance. John Ducey
