  • Can I go for plea bargain or other options available for tailgating offence?

    I was charged with a tailgating ticket when I hit a suddenly stopped car. There were no personal injury. I have a clean driving history. Should I plea not guilty and talk to the prosecutor? What options do I have?

    Pleased not guilty and hire an attorney. The ticket can be reduced to a 2 point ticket and maybe even a 0 point ticket. Tailgating is a 5 point ticket.

    You can most likely get the ticket reduced to a no point violation but I do not think you would be successful at rial with your defense.

    You are facing up to 6 months in jail and a high fine. Most towns send your type of case to an anger management or batterers intervention class and then reduce the charges and lower the fine. An attorney can help you along the way.

    The tickets will most likely be "downgraded" to things not as serious such as having an expired license. They will most likely not be dismissed in their entirety. Your PD can answer your questions since he is your lawyer.

    Your first step should be to consult in person or at least over the phone with a criminal defense attorney. There is a strong possibility of jail on the new charge and you will most likely be violated from your CD thereby bringing those charges back. What was the warrant for? Why were you pulled over? These and other issues need to be sorted out.

    An objection should have been made. When you say an admission of guilt are you the defendant? If so were you advised of your right to remain silent?
