Some states allow you to petition the court for extra fees for extenuating circumstances. Are you sure you want to do this? The executor's fee IS INCOME to you and you will have to pay tax on it -- probably over 30% if you have another job (both Federal & PA income taxes added together). I do take issue with any suggestion that you should claim the HSA and then deduct it (which would only get you “even” if you had already met the 7.5% threshold for deducting medical expenses AND exceeded the standard deduction). The 7.5% threshold means that the Congress only feels sorry for you and will let you deduct medical expenses over what it roughly the norm. The care provider does not have to be licensed, etc. the main rule is that you cannot deduct pay a dependent to provide day care. (Example: you pay your older child to watch a younger one.) Using a relative is suspect and you will be within the reach of the "economic reality" catch-all provisions for bogus deductions. Also as above, you must not wait for the SEC or MD's Attorney General to investigate this matter. Get an attorney who does "broker malpractice" or securities arbitration regularly to protect your interests. These games have to comply with the anti-gambling statutes of any state where you can play and, likely, an FTC rule on the subject.
