Divorce and tax return

Asked by a user in Paramus, NJ - 30 days ago.

You need to first speak to your own attorney and second speak to an accountant. You should not do anything until you speak to both individuals.

How do I deal with an ex that doesn't follow our agreement in a variety of ways?

Asked by a user in Saddle Brook, NJ - 2 months ago.

You may wish to file a motion to enforce your joint legal custodial rights and to clarify expense payments. You would be raising the issues involving custody not because a judge will change custody now but to lay groundwork if the negative actions by her continue afterward.

Divorce

Asked by a user in Alpine, NJ - 3 months ago.

You need to file a motion right away to enforce the order and provide proof that items are missing (by way of "before" and "after" pictures of each room, if possible).

How will our marriage affect alimony and child support which my fiancee receives from her ex?

Asked by a user in Hammonton, NJ - 3 months ago.

Marriage will end her alimony by operation (effect) of law. Her child support may be recalculated to recognize the end of that alimony, and may lead to an increase in child support depending on her current income and that of her ex husband. Your income will not come into play for child support if you and she do not have children together.

Is there anyway to enter into judgement by default with out waiting the 35 days? can a default divorce hearing be skipped

Asked by a user in 07719 - about 1 month ago.

That motion for stay does not apply to you. You need to appear in court on the default hearing date and ask for time to obtain an attorney unless you obtain one beforehand.

Ex husband lowered alimony pmts.without court., also didn't pay me 401 k. Divorced in 2005 nj What can I do?

Asked by a user in Hightstown, NJ - 3 months ago.

You should file a motion to enforce right away and you may be entitled to counsel fees if you retain an attorney to help you. Also, he may have committed fraud with the 401k so your entire divorce agreement may be subject to review.

My husband and I are living separately but have not filed for divorce yet, am I entitled to half of the tax return?

Asked by a user in Rochelle Park, NJ - 4 months ago.

You should be entitled to at least 50% of the refund but should be careful about any potential tax liability for 2011 and prior tax years. Speak to an attorney about an indemnification agreement.
