Do not be discouraged by the sometimes unethical behavior of the insurance company. If this is solely a property damage claim, (your looking to be compensated for the damage to your vehicle) then your best option is to submit the claim to your own insurance company. After that, your insurance company will then go and battle with the opposing insurance company and you will not have to worry about it. However, if this is not strictly a property damage claim and you are injured I would suggest that you seek a personal injury attorney immediately.

  • Slip and fall; didn't file police report; can I still sue homeowner and city?

Hi, I slipped and fell on ice and slush on 2/13/14 in Jersey City, NJ. I now have a torn meniscus. I didn't file a police report at the time because I thought that my knee was just sore. Can I still sue for personal injuries at this date? I wo...

With the information given, it seems as though you have a viable claim and I would suggest that you meet with a personal injury attorney. I would suggest for you not to wait too long to contact an attorney. There is a statute of limitations which provides a time frame for which you must file suit within; two years from the date of the slip and fall. Depending on liability, your claim could fall under the New Jersey Claim Tort Act which would mean you only have 90 days from the date of the fall in order to file suit. Premise liability can be a complex issue because different types of property ( single family home vs. gvt housing) have different standards and/or immunities that are attached to them. I would suggest that you seek out a personal injury lawyer through Avvo to ensure the competence of the attorney.

  • If I currently have mutiple dui's, is there a way to get my license back sooner than they've been suspended for?

The judge on one particular case after I had lost my license to a dui, took my license for twenty years stating, I was in a drug free school zone so everything doubles. I've lost my license for six months, then for twenty years. And to top it off ...

    Michael’s Answer

There is a need for more information. It does not seem that the judge’s action would amount to criminal activity. Generally, a valid license suspension will not be overturned or shortened. But if, as you suggest, the Judge had indeed made a mistake or acted in error I would suggest meeting with a lawyer to discuss if your case could be reopened for sentencing or trial.

  • If I have four dui's, one in Atlanta,Ga and three in NJ. Can I get a ignition lock device with a restricted license in Nj?

The three i have in Nj are in Piscataway, and two in Bound Brook. I recieved the one in Atlanta in the yr 2000. The one in Piscataway in 2003. The two in Bound Brook were in 2006, and 2007. Since that time I stopped drinking and completed mutiple...

    Michael’s Answer

You do not have the ability to end your suspension in exchange for the voluntary use of an Interlock. Unfortunately, NJ does not offer a restricted license program. PCR might be beneficial to your cause, but more information would be needed and I advise you seek out an attorney to discuss this. Congratulations on turning over a new leaf and trying to do what is best for your children.
