    Assuming NO other charges, you will be placed in secondary processing but you not inadmissible. Your shoplifting offense is a crime involving moral turpitude but you are eligible for the "petty offense exception". INA 212(a)(2)(A)(ii)(II). see www.njcrimmigration.com. Contact an attorney to re-open your case, amend the shoplifting to NJSA 2C:33-2a, naturalize (if you have had your green card for the requisite time period) AND STOP SHOPLIFTING.

    Depending on the facts of your case, this is much worse than a CIMT. It is an aggravated felony for immigration purposes if there is a sexual component to your charges (i.e., sexual abuse of a minor). I am sorry to say that IF the above facts are true, deportation without any relief is simply a matter of time. I would not bother to renew your green card. BUT you need to have your cases analyzed by an attorney. A favorable outcome via a PCR is difficult at best. (see State v, Telford).

    I was convicted of a conspiracy to commit robbery, and I have been offered a few jobs and the offer has been rescinded each time. The last time however was based solely off the conviction for a warehouse job. Is this legal?

    NJ is "employment at will". I can fire you if I don't like your hair cut. I can not discriminate based on race, color, creed, age, etc. If you don't have a contract with this employer, I believe you don't have a job. Consider consulting with an employment attorney.

    Mr. Abate is 1000% correct. The days of probation, SLAPP, bracelet, etc. are gone forever for a third time DWI. You need to hire an attorney and explore a "Laurick" argument regarding the prior two DWI's. My advice will always be hire someone in the area of the municipal court where you have been charged. Expect to spend at least 90 in jail if you plead guilty or are found guilty. The other 90 inpatient.

    This really depends on the nature and damages of the civil trespass. You do not need an attorney if the Judge finds probable cause...the prosecutor will represent you in municipal court. The civil trespass case is an entirely different matter. Speak to an attorney who specializes in civil litigation. Be careful. Civil litigation could easily run into thousands and thousands of dollars.

    The victim should be consulted but it is the State's ultimate determination. I suggest you apologize to your cousin through some other family member. Perhaps take care of his medical bills if any as a start.

    EVERY State is different but:
    1. You speak to the prosecutor and work out a "deal". Can't try everything. System collapses.
    2. Enter guilty plea to "deal".
    3. Pay fine, ask for community service. Most Judges will not impose C.S. but jail. If you have no problem going to jail, ask for that. $50 per day. I suggest a payment plan.

    Should You Try To Fight A Ticket Even If You Know You Broke The Law?

    My advise is a resounding yes. If you receive a NJ speeding ticket for exceeding the speed limit up to and including 14 miles over the speed limit that ticket carries 2 points. A speeding ticket where you exceed the limit by 15 or more up to and including 29 miles per hour, that violation carries 4 points. If you exceed the speed limit by 30 or more miles per hour that violation carries 5 points and Municipal Court Judges are inclined to suspend your license for a period of time for driving at that rate of speed.

    Anyone who receives a traffic violation should consult with an attorney. Attorneys who specialize in traffic ticket defense offer free consultations so you have nothing to lose and everything to gain by listening. If you have NEVER received a traffic ticket that carries points then your attorney will be pleased to inform you that there is a 2 point insurance exemption that you may utilize. Meaning, your insurance carrier will not raise your rates for this one and only time.
