Much of it depends on the facts of the case. However, you should retain counsel to review your case. Many times, an attorney will be able to negotiate a lesser charge. Herbert Tan, Esq. Rather than discussing this matter on line, you should immediately contact an attorney to discuss on how to best approach the judgment. The short answer though, is that if you have assets, they are subject to the judgment. Herbert Tan, Esq. Depending on where you worked, your claim may be better suited in State court as opposed to EEOC. The Federal Courts in NJ, although friendlier than most throughout the nation, are notorious for dismissing employment cases. With that said, you should retain counsel at this point in time. Absent a union or employment contract, you do not have a right to know the substance of the charges against you. As prior counsel correctly states, this is not a governmental entity but rather a private employer. Be patient and await the communication. I would then suggest that you retain a CELA/NELA attorney to assist you if possible. Herbert Tan, Esq. I would need more facts to properly analyze your case. In particular, what specific acts of discrimination were taken against you and when. Then, did you make complaints to your employer about such and did they reply to you. Herbert Tan, Esq. Depends on whether the self cutting is an indication of a disability or handicap. If so, and their decision was based upon your disability or handicap, then such would be discrimination based upon perception of handicap or handicap itself. However, a proper analysis of your case cannot easily be determined in this forum. I would suggest that you consult and experienced labor and employment attorney to assess your case.
