  • What kind of lawyer do I need?

I am being sued as a cosigner on a car that was repossessed. What kind of lawyer do I need?

    Max’s Answer

I would suggest a bankruptcy attorney as that is the only way that I can imagine you will be able to avoid the debt. I always caution anyone asking about co-signing that it is a extremely dangerous and bad for your credit. You cannot unring that bell. The only way to avoid that debt is to file a chapter 7 and successfully obtain a discharge.

  • Can debts that are 10 years or older, suddenly show up on my credit report.

Payday Loans, cell phones. I haven't been contacted by them and now 10 + years later, they are contacting me.

    Max’s Answer

The other attorneys have mostly answered this question, however, I would mention that most payday loans are scams that do not follow the normal rule of law. You may have a Fair Credit Report Act violation and a Fair Debt Collection Practices Act violation that may entitle you to money damages. You should speak with a Consumer Protection Attorney

Hello, My name is Max L. Rosenberg and I manage a law firm in Stratford, CT that regularly prosecuted FDCPA and FCRA violation. Depending on how long it has been since you made a payment on the debt you may have a Fair Debt Collection Practices Act (FDCPA) violation. The debt may be uncollectable. You may be entitled to up to $1,000.00 (one thousand dollars) as a penalty from the debt collector as well as attorney fees for your attorney that prosecutes the case. Please feel free to review the FAQ I have written on FDCPA on AVVO that will further explain your rights and options. You would be well advised to contact an attorney with FDCPA litigation experience to review your case. Due to the regulation on this website, I can not invite you to call me or recommend myself. However, you can use the Find a Lawyer option on this website to get any of our contact information and contact any of the few of us that handle this area of law.

  • Can i get my money back from a car dealer ship if i feel the car was falsely advertised?

i feel i was pressured into paying before given chance to see the car in person . i saw it online on their website .

    Max’s Answer

It depends on how much time has elapsed since you signed the contract. In Connecticut you have a three-day right of rescission. If you act upon this quickly, it is very possible that you can get your money returned to you. If you need help you should absolutely seek legal counsel. You should use the find lawyer search part of Avvo to find a consumer attorney.

  • Likelihood of getting a fee waiver in filing for divorce in Hartford Ct. Above poverty line but struggling financially.

Friend was denied the fee waiver when she submitted divorce paperwork. They said she can ask for a hearing. It is her and 2 kids. The husband is out of the house, living in a shelter and taking no responsibility to support himself or contribute ...

    Max’s Answer

It's always possible that the judge may take pity on her, but for 350.00 I think it's a waste of time and losing work is worse. Often the courts are very stringent about allowing the waiver as well.

    Max’s Answer

It is unlikely that any specific medication will be itemized or specified in the calculations of your settlement other than a surgical intervention need or maybe a specific expensive cortical steroid for some permanent lung conditions, as we have seen from our experience. However it can factor in as future pain and suffering and future pain medication. You should sit down with a personal injury attorney and talk in greater depth with them.
