  • Will there be any criminal charges for shoplifting at Walmart if the police officer present assured me there would not be?

    Stephen’s Answer

I would not be comfortable with this. How would the police know you did (or didn't) pay some kind of civil fine? These "civil fine" letters are usually from an out of state collection agency. if you get any court paperwork at all, contact a qualified criminal defense lawyer.

Can I appeal a CWOF with supervised probation? I wanted unsupervised probation.

    Stephen’s Answer

Maybe. This is something you need to hire a qualified criminal defense lawyer to handle. A careful evaluation of the court documents will reveal if a motion for a new trial should be filed and a hearing on the matter be scheduled.

    Stephen’s Answer

The information here is to vague and general to give a specific answer. In my experience, the nature of the charges play into this issue (not necessarily from a statutory perspective). The more serious the charge, the more leeway the judge gives the government. It shouldn’t necessarily be this way. However, that can often be the reality. Good luck!

    Stephen’s Answer

Hire an appellate attorney to review your case in its entirety. They will need to pull the tapes and have them transcribed and review all of the testimony and relevant objections. This can be a lengthy process that can become expensive. Some communities have non-profit agencies that will assist you in looking into an appeal. For example, the Innocence Project is a place to start. Good luck!
