  • Is there anyway to beat a stop sign violation in Massachusetts when in fact you didn't stop.

    But had a clear view that there wasn't any on coming traffic in there intersection at the time of said violation.

    First It is never ridiculous as an another claimed to fight a ticket. Never Never Never. I believe that advice is just wrong.
    The answer to your question is yes. You SHOULD fight this ticket.
    Did you know that you may face license consequences, lose your good driving discount and see a surcharge on your insurance if you just pay the ticket. Did you know that clerks consider good driving when ruling on CMVI appeals. Did you know that the police must present a ticket to the clerk and if they lose it they cannot present their case. Did you know that the police officer who gave the ticket must be present at a judge's appeal. Did you know that the police must report the ticket to the Merit Rating Board with a certain amount of days or the ticket MUST be dismissed. Did you know that the signage must comply with state standards.
    An experienced attorney can help you present the best argument to the Clerk or Judge. Also an experienced attorney can check to ensure that the police complied with all required procedures when the ticket was issued. An attorney can help to look to see if the signage was properly placed. An attorney can question the officer, remember the burden to prove that you ran the stop sign is on the police and your have every right to hold them to their burden.
