The good news is that if the last action taken on the case including probation occurred over ten years ago you are eligible to have the case sealed by the court. I used to advise my clients not to do this because an employer doing a CORI check would be notified that a record exists but it is sealed. What will happen to my brother who is 17 and was caught shoplifting?

Your brother should hire an attorney even though the penalty is not great for a first offense shoplifting under $100. All efforts should be made to get the case dismissed. A dismissal is eligible to be sealed by the court. In the past I never advised my clients to do this since employers doing a CORI search would be notified that a record exists but it is sealed. If you have a record in Massachusetts and the cases were either dismissed or not guilty findings entered you would be immediately eligible to have those cases sealed. A motion must be filed on your behalf in the court(s) where the entries occurred. Previously I advised my clients not to seal their CORI because future employers would be notified that a record existed but that it was sealed.
