    Defendant committed adultery and had a child out of wedlock. Parties also had 3 children together. After Plaintiff found out about the affair, he filed for Separate Support and eventually Complaint for Divorce. Case went to trial in January on issues of child custody, alimony, and division of marital assets. Judge ruled that my client (husband) have full physical and legal custody; Decreased Wife's visitation; Increased Wife's child support payments; Ordered division of 1/2 of Husband's retirement account; No order for alimony despite 10+ years of marriage.

    Description:
    Mother is the only parent listed on her son's birth certificate. The mom and son lived in NC since the child was born 4 years ago. The father, not listed on the birth certificate, lives in Massachusetts. Mother dropped the child off in MA for a 3 month vacation/visitation with the father. At the end of the 3 months, the father filed for custody and paternity in MA and refused to return the child to the mother. A legal battle ensued between the parents both here in MA and in NC. In the end, after several court appearances and police intervention, I obtained a very favorable result for my client by getting her custody of her son back and dismissing the entire custody and paternity case here in MA.
