    Description:
    I handled an OUI case where I had the charge dismissed (I argued they could not prove operation) but the judge refused to reissue the defendant's license because he refused the breathalyzer. I argued that he was entitled to a hearing after the dismissal and a presumption in favor of restoration of his license. The judge disagreed, and said "let the RMV give him a license, take me up on appeal if you want to, but I won't give him a license." I did file an emergency appeal with the Massachusetts Supreme Judicial Court pursuant to M.G.L. 211 s. 3. The single justice ruled in my favor and remanded. Within a few days, my client had his full right to operate restored.

    With the help of properly subpeoned medical records, I was able to show the jury the alleged victim was extremely intoxicated and her story was implausible. My client took the stand, admitted being part of the brawl. The jury took less than half-an-hour to acquit the defendant.

She attacked my client's friend, and when the police were called, she slammed her own face into a brick wall to contrive injuries. At trial, her whole family lied, but not well. The jury took about 40 minutes after a three day trial: Not Guilty

    Defendant had registered every 30 days (or 45 when the law required) since the law was created. The government alleged his missed on date, years ago and tried to prosecute him. Cross examination revealed and office riddled with errors in record keeping.

    Client was charged with firearm possession after an alleged armed robbery. After having Armed Robbery charges dropped, and filing motions with the Supreme Judicial Court seeking agreement that the gun should have been suppressed, we went to trial. After 5 days of testimony, the jury agreed in 20 minutes that my client was not guilty.
