    Do most personal injury cases settle after demand letter is sent? and does many go into the discovery phase before settlement?

    The majority of claims settle if liability is not disputed and insurer makes a reasonable offer within a settlement range appropriate for the particular case depending on the damages. If a lawsuit is filed, sometimes the insurer will make another attempt to settle and increase the offer soon after suit is filed. Oftentimes the insurer will wait until discovery and depositions are completed before engaging in meaningful settlement negotiations. In some cases, mediation is used to assist with settlement. Of the lawsuits that are filed, the majority settle without going to trial.

    If the other driver was at fault, then you can recover money damages for the damage to the rental car in addition to your personal injuries. That would be another element of damages in your claim.

    The Massachusetts Medicaid program is called MassHealth. Generally, MassHealth has a lien on a personal injury claim if MassHealth paid for medical bills related to the accident. Any cancer related medical bills would not be related to the accident and would not, in my opinion, be subject to a MassHealth lien. I assume that your sister's partner had a lawyer handling injury claim. The lawyer is more familiar with facts of this particular case and should be able to answer this MassHealth lien question.

    You don't need referrals for PIP. However, if you have private health, your health insurance plan may require a referral. In that case, you could be in a situation where PIP only pays $2,000 and private health insurer denies the remainder of bills because no referral. On the other hand, there are certain private health policies that are controlled by a federal law called ERISA in which case PIP must exhaust the full $8,000 before private health pays any medical bills. You should contact an experienced personal injury lawyer immediately.

    Based on your description, I would say that the other driver is at fault. Your medical bills and lost wages, if any, will be paid by PIP through your auto insurer. If you incur medical bills that altogether total more than $2,000, them you can make a bodily injury claim through the other driver's insurer. You should contact a personal injury lawyer immediately.

    You only get COLA in workers comp in Massachusetts if you're receiving s. 34A permanent total benefits. If you're on s. 34 temporary total or s. 35 partial benefits, no COLA.

    Difficult to say without more information. It would be helpful to have a plastic surgeon evaluate scars to report if they are permanent and what, if anything, could be done to remove them or improve appearance together with estimated cost. Usually takes at least six months to before evaluation can be done to evaluate scarring since scars' appearance may change as skin heals. You really should contact a personal injury lawyer to evaluate your potential clim and represent you. In my experience, insurance company will low ball you if you attempt to handle this yourself and you don't have experience or information to know what's fair settlement.
